Probate is the process by which a county court validates a decedent’s Will (if the decedent had one) and administers the decedent’s estate pursuant to the Will or, if the decedent did not leave a Will, then the intestacy laws of the state. Probate can be a complex, lengthy process which requires the court’s approval for distributions of assets and the opening and closing of the estate.
There are many factors that must be considered following the death of an individual. Proper planning during life can allow the estate to avoid probate, but when probate is required, an experienced attorney can help you administer the estate in the most efficient way possible.
